Terms of Service

Welcome to Launchpad. These Terms of Service ("Terms") govern your access to and use of the Launchpad website, apps, and services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1. Who We Are
Launchpad is an online platform where users discover, submit, and promote technology products and related content.
2. Governing Law
These Terms and any disputes arising out of or relating to them are governed by the laws of the Netherlands, without regard to conflict-of-law rules.
3. Eligibility and Accounts
Age
You must be at least 16 years old to use Launchpad.
Account Information
Provide accurate and complete information, and keep it updated. You are responsible for all activity under your account.
Security
Keep your login credentials confidential. Notify us immediately if you suspect unauthorized use.
Only one account per person or organization is allowed unless otherwise agreed.
4. User Conduct
You agree not to use the Service to:
- Break the law or infringe on rights (including intellectual property, privacy, or publicity).
- Upload or share content that is illegal, deceptive, fraudulent, defamatory, harassing, hateful, discriminatory, threatening, sexually explicit, or otherwise harmful.
- Upload malware or viruses, or attempt to bypass security or access non-public areas.
- Scrape, crawl, or use automated means without permission.
- Spam, manipulate rankings, or artificially inflate engagement.
- Misrepresent your identity, affiliations, or the nature/performance of submitted products.
- Interfere with the Service's operation or other users' experience.
We may take appropriate action (including removal, suspension, or termination) if we believe conduct violates these Terms or applicable law.
5. Content and Intellectual Property
a) Launchpad Content
Ownership: The Service (including text, graphics, logos, badges, software, and design) is owned by Launchpad or its licensors and protected by intellectual property laws.
License to You: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose in accordance with these Terms.
b) User-Generated Content ("UGC")
Your Rights: You retain ownership of UGC you submit (e.g., product listings, images, descriptions, comments).
Your License to Launchpad: By submitting UGC, you grant Launchpad a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify (for formatting/display), publish, publicly display, distribute, and promote your UGC in connection with the Service and Launchpad's marketing. This license lasts until you remove your UGC from the Service; reasonable technical copies, backups, or cached versions may persist for a limited time.
Warranties About Your UGC: You represent and warrant that you have all rights necessary to submit the UGC and grant the above license; that your UGC does not infringe any third-party rights or violate any law; and that your UGC is accurate and not misleading.
Feedback: If you send suggestions or feedback, you grant Launchpad a perpetual, irrevocable royalty-free license to use them without restriction.
c) Notice-and-Takedown (Copyright/IP)
Reporting: If you believe content infringes your rights, contact us using the details below with: (i) identification of the work/right; (ii) identification of the allegedly infringing content and its location; (iii) your contact details; (iv) a statement of good-faith belief; and (v) a statement that the information is accurate and that you are authorized to act.
Counter Notice: If your content is removed and you believe it is not infringing, you may submit a counter notice explaining why and providing supporting information. We may restore content at our discretion subject to law.
Repeat Infringement: We may suspend or terminate accounts of repeat infringers.
6. Moderation and Ranking
Launchpad may—but is not obligated to—review curate or moderate submissions. Display order trending lists and badges may be determined by a mix of community signals and internal criteria; we may update these criteria from time to time. We may remove or demote content we consider low quality misleading or abusive.
7. Third-Party Links and Services
The Service may link to or integrate third-party sites and services (e.g., product websites or analytics badges). We are not responsible for third-party content or practices. Your use of third-party services is at your own risk and may be subject to their terms.
8. Paid Plans and Billing (if applicable)
If you purchase a paid plan via /pricing:
Billing: Fees billing cycles and features are described at the point of purchase.
Taxes: Prices may exclude applicable taxes; you are responsible for taxes unless otherwise stated.
Refunds: Unless required by law fees are non-refundable once the billing period begins. Local consumer rights (including statutory warranties and withdrawal rights where applicable) are not affected.
9. Suspension and Termination
We may suspend or terminate access to the Service or remove content with or without notice if:
- You violate these Terms or applicable law.
- We are required to do so by law or court order.
- We reasonably believe your use poses risk to users the Service or our reputation.
You may delete your account at any time. Upon termination your license to use the Service ends but Sections 4 and 9–14 survive termination.
10. Disclaimer of Warranties
To the maximum extent permitted by law the Service is provided "as is" and "as available."
We do not guarantee uninterrupted or error-free operation nor accuracy completeness or reliability of any content.
For consumers in the EU/Netherlands: nothing in these Terms excludes or limits statutory rights and legal guarantees that cannot be excluded by contract.
11. Limitation of Liability
To the maximum extent permitted by law Launchpad and its affiliates officers employees and agents are not liable for indirect incidental special consequential punitive or exemplary damages; loss of profits revenues data or goodwill; or business interruption arising out of or in connection with the Service or these Terms.
Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of:
(a) €100;
or
(b) The amounts you paid to Launchpad for the Service in the 12 months preceding the event giving rise to the claim.
These limitations do not apply to liability that cannot be excluded or limited under Dutch law (e.g., for death or personal injury caused by negligence).
12. Indemnification
You agree to indemnify and hold Launchpad harmless from claims losses and expenses (including reasonable legal fees) arising from your UGC your use of the Service or your violation of these Terms or rights of others—to the extent permitted by law and subject to consumer protections.
13. Dispute Resolution
Informal Resolution
Please contact us first to resolve issues. We will try to address complaints promptly.
EU Consumer ODR
If you are a consumer within the EU/EEA/EFTA regions you may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.
Arbitration for Business Users
If you use the Service for business purposes and any dispute is not resolved informally within 30 days it shall be finally settled by binding arbitration under Netherlands Arbitration Institute (NAI) Rules. The seat shall be Amsterdam; proceedings will be in English or Dutch before one arbitrator unless NAI decides otherwise.
Courts for Consumers
If you are a consumer you may bring claims in either the competent courts where you reside or in Amsterdam.
Class Actions
To the extent permitted by law disputes are resolved on an individual basis; class actions are not permitted in arbitration.
14. Privacy
Your use of the Service is subject to our Privacy Policy explaining how we collect and process personal data.
15. Changes to These Terms
We may update these Terms from time to time. If changes are material we will provide reasonable notice (e.g., posting a notice on-site or emailing registered users). The updated Terms become effective on the posted effective date. Continued use after this date constitutes acceptance.
16. Beta Features & Changes
We may test new features without notice. Beta/experimental features may be less stable and are provided "as is."
17. Communication & Notifications
You consent to receive service-related communications electronically (e.g., emails/in-app notices). You can manage non-essential communications in account settings.
18. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger/acquisition/sale of assets.
19. Severability & Waiver
If any provision is found unenforceable/invalid all other provisions remain in effect. Our failure to enforce a provision does not constitute waiver.
20. Entire Agreement
These Terms—together with referenced policies including Privacy Policy & badge rules—constitute the entire agreement between you & Launchpad regarding your use of this Service.
